RAIPUR: The Chhattisgarh High Court issued a notice to the Director General of Police (DGP), Chhattisgarh, and the Inspector General of Police (IGP), Bilaspur Range, in a case concerning compassionate appointment for a married woman after the death of her unmarried brother.
Kranti Singh Rajput, a resident of Farhada village, Bilaspur, was working as a constable in Korba. After Kranti’s death on April 13, 2023, his married sister, Nidhi Singh Rajput, applied to the superintendent of police, Korba, seeking the post of ASI (M). Her application was rejected on the ground that she is the married sister of the deceased.
Nidhi then moved the high court and filed a writ petition through Counsels Abhishek Pandey and Swatirani Saraf.
The counsels submitted that the Chhattisgarh govt's compassionate appointment policy of 2013 stated that the father, mother, brother, and unmarried sisters would be eligible for compassionate appointment of the govt servant if he or she died during service. However, on March 22, 2016, the state govt amended the policy by deleting the word "unmarried" from "unmarried sister."
The counsel argued that under this amendment, the married sister of an unmarried brother who dies during govt service would be eligible for compassionate appointment.
Counsel Pandey said that the high court allowed the writ petition based on the 2016 amendment to the policy and issued a notice to the DGP and the IGP, asking them to submit their reply as soon as possible.
